The following general terms and conditions (hereinafter “Terms and Conditions”) apply to all hiking events (“24-hour Edersee hiking adventure; Edersee autumn hiking week”) (hereinafter referred to as “hikes”) that are organized and carried out by Edersee Marketing GmbH (hereinafter referred to as “Edersee Marketing”) become.
The General Terms and Conditions are therefore part of every agreement concluded for hikes between Edersee Marketing and the participant.

1. Conclusion of an agreement for a hike carried out by Edersee Marketing (binding booking)
1.1.
Registration for the hikes conducted by Edersee Marketing can be done via the online page offers.edersee.com or corresponding links can be made there. The booking and payment process is carried out with the support of the software/service from Regiondo GmbH.
1.2.
The number of participants in the hikes is limited. The exact number of participants is determined in the non-binding offer by Edersee Marketing.

2. Services and program of hikes
The content and scope of the contractually agreed services and program items of the hikes offered result from
1. a) the specific offer of the hike made by Edersee Marketing
2. b) the information in the registration confirmation and
3. c) these General Terms and Conditions.

3. Cancellation and program changes of the hikes, force majeure
3.1.
Edersee Marketing reserves the right to make changes to the hike program and the schedule (postponement, interruption, extension) of the hiking route or to cancel the hike in individual cases. These deviations from the hike program may occur for the following reasons:
* Safety of participants
* Insufficient performance of the participants
* Force majeure (e.g. weather-related, fire risk, landslide)
3.2.
Edersee Marketing also reserves the right to exclude disruptive participants from the hikes.
3.3.
In the aforementioned cases, the participant will not receive a refund of their participation fees.

4. Requirements profile of the participant
4.1.
The participant decides on his own responsibility whether he will take part in the hiking event at his own risk and whether he will complete it to the end. The prerequisite for participation is physical fitness and health as well as suitable clothing and equipment appropriate to the occasion, weather and season. Each participant therefore ensures physical and mental fitness as well as the required level of well-being and is responsible for this themselves.
4.2.
Skills and fitness are to be fulfilled on one's own responsibility without being checked or questioned by the organizer and his vicarious agents or vicarious agents.
4.3.
If the organizer and/or his vicarious agents become aware of a participant's inadequate equipment or circumstances that could endanger his or her safety and the safety of other participants, this participant may be excluded from the hike without claiming a refund of the participation fee paid can make.

5. Obligation of participants in the hikes
5.1.
Each participant takes part in the hike at their own risk.
5.2.
The participant is obliged to carry the start card/wristband/or similar issued by Edersee Marketing with them during the hike and to use/show it accordingly.
5.3.
The participant undertakes to observe the customs, customs, the surrounding landscape as well as regulations and laws and the requirements of nature and environmental protection. In the event of violations during the hikes, the affected participant can be excluded from the hike by Edersee Marketing and/or its vicarious agents (e.g. employees/authorized representatives of the protected areas/etc.).

6. Participation of minors
6.1.
In principle, only people who have reached the age of 18 are allowed to take part in the hikes.
6.2.
People under 18 can only take part if they meet the physical and mental requirements for the hikes. Registration must be done by the legal guardian. The parallel participation of a legal guardian in the hike is mandatory.

7. Participation of dogs/animals
7.1.
Only dogs can take part in the hike as animals. To protect people and animals, the dogs must always be kept on a leash by a suitable person as a participant, so that the dogs cannot injure other people and animals and the dog's well-being is not impaired by the hike.
7.2.
If the organizer and/or his vicarious agents or vicarious agents become aware that the provisions in Section 7.1. If the conditions mentioned are not met, the dog and the participant will be excluded from the hike without being able to claim a refund of the participation fee paid.

8. Registration & Payment Terms
The prerequisite for active participation in the hike is written registration (binding booking) via the website offers.edersee.com (or via the corresponding redirects) under the conditions stated there as well as the possible necessary consent and participation of a legal guardian of the minor (see Section 6.2.) and the prior full payment of the participation fee.

9. Withdrawal of the participant
9.1.
If a person does not take part in the hike despite having registered and paid the participation fee on time as well as confirmation from Edersee Marketing, the participation fee will generally not be refunded.
9.2.
If the hike is canceled for which Edersee Marketing is responsible, Edersee Marketing offers the participant to conclude an agreement for another hike from Edersee Marketing instead of the canceled hike and to have the participation fee credited accordingly or to the participant the participation fee paid for the canceled hike to be reimbursed.
9.3 The participant can withdraw at any time before the start of the hike. The decisive factor is receipt of the declaration of withdrawal by Edersee Marketing via email (buchhalte@edersee.com).
In the event of the participant's withdrawal, Edersee Marketing is entitled to the following percentage compensation, taking into account usually saved expenses and usually possible alternative use of the service - in each case per hike based on the participation fee:

up to 90 days before the start of the hike: 0%
up to 14 days before the start of the hike: 15%
No refunds are possible from 13 days before the start of the hike. A partial refund for a hike is not possible. There is no further processing fee.

10. Consent to taking photos during the hike
The participant of the hike irrevocably and free of charge for all current and future media agrees that Edersee Marketing is entitled to produce or have produced image and/or sound recordings of the participant alone or with other participants in connection with the hike and/or to use such images and/or sound recordings for its own purposes and/or for the benefit of its partners and/or sponsors in all current and future communication media.

11. Use of GPS / GPX files / orientation media
Any GPS / GPX files / tour routes / maps / etc. (orientation media) provided by Edersee Marketing serve as a rough orientation for the participant. The organizer is free to change the hiking route at short notice at any time, which may differ from the media already provided.

12. Limitation of liability
12.1.
Participation in the hike is at your own risk. Edersee Marketing expressly points out that long-distance hikes are always subject to a particular risk.
12.2.
Edersee Marketing, its legal representatives and/or its vicarious agents are only liable for damages caused to the participant either intentionally or through gross negligence. Claims for damages resulting from injury to life, body or health as well as under the Product Liability Act remain unaffected by the above restrictions in sentence 1.
12.3.
Edersee Marketing, its legal representatives and/or its vicarious agents are not liable for third-party services and any resulting damages, but rather the respective service provider directly.

13. Privacy policy
13.1.
The participant agrees that the personal data specified in the registration will be stored, processed and used by machine and that they may be published in the list of participants and results, including on the Internet and in newspapers.
13.2.
The participant agrees that the data specified in the registration for starting card printing, placement and results of the hike may be recorded and published.
13.3.
The personal data provided during this event will not be passed on to third parties.
13.4.
The participant agrees that he or she will continue to be informed about this event and similar future events via, among other things, newsletters (e-mail). In this context, we would like to point out that the consent given here can be revoked with effect for the future.
13.5.
All data transmitted by the participant will be processed and processed by Edersee Marketing in compliance with the relevant data protection regulations and stored within the framework of the legal requirements.

14. Compliance with the Corona regulation of the state of Hesse
14.1.
Compliance with the federal Corona regulations and/or valid regulations of the state of Hesse in force at the time of the event is mandatory for the participant.
14.2.
Edersee Marketing carries out the legally required contact tracking via the participant lists with attendance checks and/or the Luca app.
Edersee Marketing is entitled to record and store the respective status (vaccinated, recovered, tested) on the day of the event within the scope of the legal requirements.

15. Others
The exclusive place of jurisdiction for all disputes arising from and in connection with these General Terms and Conditions is - to the extent permitted by law - Fritzlar.
